COMPETITION ENTRIES:
Entries are only open to persons 18 years and over, who are residents of Hawke’s Bay, New Zealand and have not had a portrait experience with Samantha Polatsek Photography within the last 12 months. Late entries will not be accepted. Entry forms not properly completed will be rejected. Copies will not be accepted. Prize winners will be notified by email or phone. The decision of the studio will be final and no correspondence shall be entered into.
PROMOTIONAL GIFT CERTIFICATES & SPECIAL DISCOUNT OFFERS:
Must be redeemed prior to the expiry date specified on the Gift Certificate or by the Special Offer deadline. One Gift Certificate/Discount Offer per household. One Gift Certificate/Discount Offer per Portrait Experience. Prizes are non-transferable and are not exchangeable or redeemable in whole or in part for any cash equivalent. Cannot be used in conjunction with any other separate offer or promotion.
APPOINTMENT BOOKING DEPOSIT and SESSION FEE:
A booking deposit of $100 or a session fee will be required to secure and hold your Portrait Experience appointment. This deposit or fee ensures your commitment to the scheduled appointments. If you have a gift certificate the deposit is refundable, provided that you have completed both your portrait session and design consultation at the correctly scheduled time and date. Failure to attend or complete your scheduled appointments or failure to cancel within 5 days of your appointments, will result in the forfeiture of your booking deposit or session fee and any promotional gift certificate or special discount offers.
NON-TRANSFERABLE:
Promotional Vouchers, Special Discount Offers and Gift Certificates are NON Transferable and can not be transferred or gifted between clients. They are not exchangeable or redeemable in whole or in part for any cash equivalent. The vouchers and gift certificates cannot be used in conjunction with any other offer, prize or promotion. Only one (1) Gift Certificate can be used at a time. You cannot use the Gift Certificate to purchase products from any other photo sessions.
FACEBOOK & INSTAGRAM COMPETITIONS:
By entering our Facebook and/or Instagram competition, the entrant acknowledges that the promotion is in no way sponsored, endorsed, administered by or associated with, Facebook or Instagram in any way.
CELL PHONES – PHOTOGRAPHS
During a professional photo session, it is essential to maintain a high level of respect and consideration for the photographer and the creative process. As such, the use of cell phones or personal cameras by clients to take photos during the session is not acceptable. There are various reasons for this policy. Firstly, having clients take pictures with their phones can disrupt the flow and atmosphere of the shoot, causing distractions and hindering the photographer’s ability to capture the best shots. Additionally, it may compromise the photographer’s copyright and artistic ownership of the images, as unauthorised photos taken by clients could potentially be shared or used without proper attribution.
ARTISTIC CONTROL:
Samantha Polatsek Photography reserves artistic control over the design and content of each photo session. We may, at our discretion, decline to create certain types or styles of photography. We reserve the right to refuse to produce images at some sizes or combinations of sizes if we believe such images would or could be detrimental to our reputation as a professional studio or as professional photographers.
Clients should discuss their requirements with the studio prior to the portrait session.
REFUSAL OF SERVICE:
Samantha Polatsek Photography reserves the right to refuse service if, in our opinion, the provision of service is likely to cause or has caused disruption to either staff members, other clients or the normal operation of business.
Samantha Polatsek Photography reserves the right to refuse any animal, including any that poses a threat to the safety of staff or clients.
WHOLE FAMILY POLICY:
Samantha Polatsek Photography reserves the right to refuse service if the entire family does not attend the portrait session and purchasing appointment.
APPOINTMENT RESCHEDULE POLICY:
Gift Certificates and Promotional Vouchers entitle the holder to a SINGLE PORTRAIT EXPERIENCE ONLY. Once made, an appointment cannot be rescheduled and the Gift Certificate is deemed to have been used in full at that original appointment time and date.
*NOTE: In exceptional circumstances, management may, at their sole discretion, reschedule an appointment and carry forward the Gift Certificate and holding fee / deposit
NON ATTENDANCE POLICY:
Non attendance at any appointment without notice, will result in the forfeiture of the booking deposit and the withdrawal of any special offers. Any Gift Certificates are then deemed to have been used in full if you fail to attend or complete your scheduled appointments.
COPYRIGHT OWNERSHIP:
Unrestricted Copyright to all images created during the portrait experience is deemed to belong solely to Samantha Polatsek Photography I agree that all original capture and copyright of all printed and digital Portrait imaging remain the property of Samantha Polatsek Photography and they must not be copied or replicated in any format, unless otherwise specifically agreed in writing. Samantha Polatsek Photography has the right to use reproductions for the purpose of creating samples of work, entry into photographic competitions, exhibitions, advertising, editorial or art displays, general displays, or any other commercial application for Samantha Polatsek Photography.
DIGITAL PORTRAIT COLLECTIONS – PRINT RELEASE:
The below applies to all Digital Portrait Collections purchased and received from Samantha Polatsek Photography.
1. You have permission to use the high-resolution digital portraits provided to you for personal use only, including but not limited to printing, copying, emailing and online publishing.
2. The Digital Portraits cannot be used for commercial or editorial purposes without written consent from Samantha Polatsek Photography. You may not use the digital portraits in any way that results in financial gain, including but not limited to advertising, stock photography or resale of any nature.
3. You may not edit or alter the digital portraits in any way or claim them as your own.
4. Samantha Polatsek Photography is not liable for colouring errors, print quality or cropping of any portrait not printed directly by Samantha Polatsek Photography.
5. Copyright ownership of all Digital Portraits remains with Samantha Polatsek Photography.
REFUNDS:
We are not required to provide a refund or replacement if you change your mind once your order has been placed. We offer a quality guarantee on all artistry and workmanship.
MINI SESSIONS:
Because Mini Sessions are available on a limited basis, all Mini Session bookings are final and non-refundable.
